Hail the liquor ban
We welcomed in the New Year
with families and fireworks. What
was missing? The only thing I can
think of, having policed 20 New
Years, were the drunks. We had
an excellent New Year in Te Anau.
No arrests and no significant
incidents were attended by police.
The atmosphere was great!
Liquor bans have become
common place in New Zealand in
recent times. Why? Because major
events all around our nation have
been hijacked for quite some time
by the very people who care least
about them; antisocial drunks.
Liqour bans and controlled sales
of alcohol have empowered
families to feel they can head
out to an event without the likely
prospect over an intoxicated
element ruining things. I don't
wish to sound like the 'fun police'
here, but quite honestly we have
had issues to deal with here as a

unrestricted and uncontrolled
abuse has been so common that
we had almost come to accept
it. I say 'almost' because as a
society we have been tolerant.
Local councils and concerned
individuals stood up and said
'enough' and the 'liquor ban' was
conceived. It is a local bylaw that
allows police to exercise some
controls. They are enforced with
common sense and no law abiding
citizen has anything to fear. Most
members of the public have
readily adapted to the concept and
see the benefits.
Commenting on alcohol
restrictions I would also like to
congratulate the Te Anau Rodeo
Club for introducing a policy of not
allowing BYO into their event. This
year's event was exceptionally well
run and well attended.
Patrons can still enjoy a beer or
glass of wine from the licensed
bar, but the wheel barrows and
paddling pools full of booze are a
thing of the past. The groups who
accompanied theses portable
breweries will probably find the
whole event less attractive. This
of course leaves those who enjoy
watching cowboys riding and
wrestling large and dangerous
beasts to do so without the
distraction of any 'animals' of the
human variety creating their own
show on the embankment.
As I write this, the harness
races have just been held. Early
indications are that they were a
great success once again. Well
done Te Anau Events group. Police
were, however, kept busy around
town with the extra the people
about and attended several
incidents (unrelated to the actual
races) involving, you guessed: it
excess alcohol. Until next time,

The Wallacetown and Wyndham Community Boards will have a full board for the next three years after
one nomination was received for each of them in the recent byelection.
Electoral Officer Phil Culling said no election was needed as each of the boards had one vacancy and
the two nominations filled them. Stephen John Geary is the new board member for Wyndham and Rae
Wilson is the new board member for Wallacetown.
"Unfortunately we did not receive any nominations for the vacant seat on the Edendale Community
Board," Mr Culling said. "The board can now co-opt someone onto the board."
The nominations closed for the byelection on December 23, 2010.

The Southland District Council's roading manager is warning that ongoing vandalism to signs in the
district could put lives at risk. Michael Voss said bridge weight restriction signs had been vandalised
and defaced, particularly in the Wallace area. These signs were significantly important because they
alerted drivers to exactly what weight a bridge could hold without compromising safety and the bridge's
structural integrity. Failure to know this information could have dire outcomes, he said.
"Any such act could have serious consequences
including injury or even death and any person
found responsible will be prosecuted accordingly,"
Mr Voss said.

Buying at Mortgagee Sale
-- Not always a bargain!
Although not yet com mon in Southland,
the number of mortgagee sales across NZ
So what is a mortgagee sale?
A mortgagee sale occurs when the
property owner defaults in payments
of any loan that is secured by their
property. After going through the notice
procedures, the mortgagee (normally
the Bank) is able to sell the property to
recover debt owed. More often than not,
a mortgagee sale is conducted by way of
auction or tender.
What are the pitfalls?
An agreement for a mortgagee sale is
normally weighted heavily in favour
of the mortgagee to give maximum
protection possible if there is a sale.
Because of this, a number of the usual
protections afforded to a purchaser will
be deleted, such as:
• The mortgagee will not promise
that vacant possession will be given
on settlement. If the owner is still in
possession on settlement you are still
required to settle and it will be your
responsibility to remove the owner.
• The agreement will be unconditional
as soon as you sign the agreement but
the mortgagee will still reser ve the right
to cancel the agreement if they
are unable to transfer title for
• All the normal vendor warranties,
such as the building complying with
the Building Code, will be deleted.
• You will be deemed to have accepted
the title of the property
• The sale will not include any of
the nor mal chattels (e.g. stove, carpet,
drapes...) meaning the owner could
remove these prior to settlement.
• The mortgagee will not warrant that the
property will be habitable on settlement
and a disgruntled owner could
potentially cause damage that you will
then be responsible for.
If you are looking at buying a mortgagee
sale you need to do your homework before
signing on the dotted line. This will
involve during a thorough investigation
of the property and consulting with your
